The Law Society is of the view that the deposit money is held in trust for both the vendor and the purchaser and as such the funds can only be disbursed in ance with a direction from both parties, or by way of a court order.

Deposit Deed means an agreement that is Enforceable and in such form as provided to the Reservation Party from time to time by NGG enabling the deposit of cash as security. Effective Date means the date of this Agreement.

It is usually the Landlord that will require the Tenant to pay a rent deposit, and, in such situations, a Rent Deposit Deed will be needed. The Landlord should not accept a rent deposit and the Tenant should not pay a rent deposit, without the existence and protection of a Rent Deposit Deed.
