There is no time limit set for settling a succession in the Civil Code of Quebec. However, there are several steps in its liquidation that must be completed within a given time. For example, heirs have six months from the time of death to accept or refuse a succession.

If you need to close a bank account of someone who has died, and probate is required to do so, then the bank won't release the money until they have the grant of probate. Once the bank has all the necessary documents, typically, they will release the funds within two weeks.

The Quebec Civil Code doesn't set particular time for Estate settlement. It is clear though that certain steps should be made within corresponding time limits. For example, heirs have 6 months to accept or renounce the inheritance.

If the executor has obtained a grant of probate, the executor is generally allowed one year to gather in the assets and settle the affairs of the estate.

The affidavits will include an inventory of the assets and the debts of the person who died. Once a grant of probate or administration has been issued by the Supreme Court of BC, the executor or administrator will have full authority to deal with the estate assets. He or she must pay the debts of the person who died.

If probate is required, the law says that you can't distribute the estate until 210 days after probate is granted and no claim is made against the estate. If every person who has a potential claim on the estate signs a form saying they won't challenge the will, you can go ahead and distribute sooner.

There is no specific time limit, but the liquidator should complete the task as soon as possible. If the liquidation takes more than one year, the liquidator must submit a report on his or her administration to the heirs, creditors and legatees by particular title who have not yet been paid.
