The EU has put in place two separate laws: the Digital Services Act and the Digital Markets Act, both better known by their initials, DSA and DMA. The DSA became legally enforceable on Aug. 25, laying out content rules for social media platforms, online marketplaces and app stores.

The European Commission provides a free web service for the buyers, bidders and other parties interested in filling in the ESPD electronically. The online form can be filled in, printed and then sent to the buyer together with the rest of the bid.

The DMA is a new piece of legislation designed to harmonize platform regulation across the EU and ensure fair and open digital markets. The legislation comes into effect in March 2024. The DSA applies to all online intermediary service providers who offer 'mere conduit', caching or hosting services in the EU. The nature of these services is broadly cast and covers: intermediary services offering network infrastructure such as internet access providers, domain name registrars and online search engines.

The DSA regulates ?intermediary services,? such as social media, online marketplaces, and search engines. It includes provisions aimed at preventing targeted advertising practices that profile minority groups, minimizing illegal content and hate speech on the internet, and protecting minors from harmful content online.
