The Residential Program provides Crown land for permanent residential development by individuals and private developers. Crown land may be made available in urban and rural areas either by public tender or public lot draw.

It is illegal to use, occupy or build structures on Crown land without prior approval.

Your activities on the land must demonstrate that you believe that the land is yours and that the person with the deed to the land has no right to the land. If you are claiming land owned by a private individual, you need to show 20 years of continuous use and occupation.

Requests by individuals to buy Crown land may be authorized by the Minister or Cabinet under the Crown Lands Act and under other Acts such as the Beaches and Foreshores Act. The Sale of Crown Land Policy provides direction to the department regarding circumstances in which Crown land may be sold.

Completed Applications for Consent and Notice of Assignment of Lease/Licence, confirmation of payment and supporting documents must be submitted to a CROWN LANDS REGIONAL OFFICE. To transfer/assign a lease/licence from one individual to another, this form must be fully completed by the seller(s) and the purchaser(s).
