What is the N12 notice? Form N12 is a notice to end the tenancy that can be given to the tenant if the rental unit is required for residential use by someone such as a landlord, purchaser, or caregiver.

The tenant can dispute the N12 Notice at the Landlord and Tenant Board.

File an L2 with the Landlord and Tenant Board no later than 30 days after the termination date on the N12. If accepted, your landlord's application for eviction will prompt a hearing where you can defend your tenancy.

Section 48(1) of the RTA permits the landlord to give notice of termination to a tenant if the landlord, in good faith, requires the unit for residential occupation for a period of at least one year by the landlord, a specified family member or a caregiver. You will then have to act very quickly to try to stop the eviction. You must file a Motion to Set Aside an Ex Parte Order with the Board as soon as possible. But to be safer, you must do this within 10 days after the date of the order. You can get forms for filing this motion from the Board.

Under our current laws in NSW, a landlord can evict a tenant without grounds with just 30 days' notice at the end of their fixed-term lease, or with just 90 days' notice during an on-going lease. Rental laws in many other countries don't allow 'no grounds' evictions. Why do things need to change?

Counting a 5 day notice: If a landlord is giving a 5-day notice to a tenant, the landlord cannot count the first day it was served. For example: 5-day is served on June 30, 2014. June 30 does not count (it was the day served), so the first day counted in the notice is July 1.
