In the state of Texas, minor children (any person under the age of 18) cannot legally own any real property or be entitled to receive any assets.

Adding a family member to the deed as a joint owner for no consideration is considered a gift of 50% of the property's fair market value for tax purposes. If the value of the gift exceeds the annual exclusion limit ($16,000 for 2022) the donor will need to file a gift tax return (via Form 709) to report the transfer.

There are a few types of deeds that accomplish this in California, including a quitclaim deed, grant deed and transfer on death deed.

While it is legal for a child to own real estate, a child cannot convey (sell or transfer) real estate until he or she has reached the age of majority.

Unless the gift amount exceeds the entire estate exemption (which is $24.12 million for married couples in 2022), no taxes will be due on the gift.

First, while real property can be conveyed directly to a minor, property owned by a minor cannot be sold, mortgage or otherwise encumbered without the appointment of a guardian through the Clerk of Court's office in the county where the property is located.

For 2018, 2019, 2020 and 2021, the annual exclusion is $15,000. For 2022, the annual exclusion is $16,000.
