Under the interim final regulations, the obligation to make dependent coverage available to children ends the day before the child's 26th birthday. Sponsors of group health plans will be required to make dependent coverage available to children up until that day.

An overage dependent is a dependent who has reached a predetermined age, set by the Insurer. At this age, the employee benefits plan will no longer cover them, unless they are re-classified as an overage dependent. Ages for this cutoff may vary by Insurer, but either 19 or 21 years of age is common.

If you are currently covered under your parent's health plan and you will be turning 26 soon, your parent's employer is required, under the Patient Protection and Affordable Care Act, to make coverage available until the end of the month in which you turn 26.

The Affordable Care Act requires plans and issuers that offer dependent child coverage to make the coverage available until a child reaches the age of 26. Both married and unmarried children qualify for this coverage.

An insurer can choose to implement their own age range for dependent student and non- students from 18 years up to 31 years. For example, an insurer that currently has a maximum age for dependent non-students of 24 years in their insurer rules, may increase the maximum age to 29 years rather than 31 years.

A child or other individual for whom a parent, relative, or other person may claim a personal exemption tax deduction.

Over-age Dependents must meet both of the following requirements for a disability exception: 1) They are incapable of self-sustaining employment due to a physically or mentally disabling injury, illness, or condition. 2) They are chiefly dependent on the subscriber for support and maintenance.

Children for whom you or your spouse have been appointed legal guardian. Foster children placed with you or your covered spouse. Financially dependent grandchildren who live with you or your covered spouse continuously from birth Children allowed to obtain health coverage by a Qualified Medical Child Support Order.

If you are registered for the last term of your program and are studying part time, you are still eligible for public health insurance with the RAMQ.

In most group health insurance plans, children are covered up to age 21 if they're not in school, or up to age 25 if they're enrolled in a post-secondary program.
