1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.

Purpose. Section 1 effects a balance between the rights of the individual and the interests of society by permitting limits to be placed on guaranteed rights and freedoms.

Construction projects are typically broken down into basic operations (work sections) which involve undertaking tasks that are similar and therefore convenient to group as one activity. This may be for the purposes of phasing or to realise time or cost savings.

The Charter protects those basic rights and freedoms of all Canadians that are considered essential to preserving Canada as a free and democratic country. It applies to all governments ? federal, provincial and territorial ? and includes protection of the following: fundamental freedoms, democratic rights.

1. a part cut off or separated from the main body of something. 2. a part or subdivision of a piece of writing, book, etc. the sports section of the newspaper.

Unconstitutional means that a law or action committed by a government official falls outside the authority granted by the United States Constitution.

In accordance with section 32 of the Charter, an action for damages for a breach of Charter rights is a public law action directed against the state for which the state is primarily liable.

When laws, procedures, or acts directly violate the constitution, they are unconstitutional. All others are considered constitutional unless the country in question has a mechanism for challenging laws as unconstitutional.

If a statute is facially unconstitutional, the courts have stated that it cannot be enforced and the legislature may choose to repeal an unconstitutional statute to avoid confusion or to replace that statute with a new version that seeks to reach similar policy goals.

52. (1) The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.
