If the grand jury finds that there is enough evidence for the case to go forward, they will issue an indictment. Once the grand jury issues an indictment, an arraignment hearing will occur within about two to four weeks after an indictment has been handed down.

Typically, there's no limit on the number of continuances that a defendant can request. That said, a judge won't look favorably on repeated requests, especially if they appear to be delay tactics. Repeated requests, made without good cause, will be denied. (The judge could also reprimand the lawyer.)

For example, let your lawyer know you are having surgery and will not be physically able to go to court. Your attorney will go to court and tell the judge why you're not there, but they have to know the reason first.

If you've been arrested for a felony offense, the court has 90 days to prepare and begin your trial. For Class A misdemeanors, they must start your trial within 30 days of your arrest. Class B misdemeanors give the court 15 days to initiate your trial, and class C misdemeanors only allow the court 5 days to prepare.

If you wish to reschedule your court date more than once for any reason, you must file a written "Motion for Continuance" at the Court Clerk's office on or before the scheduled court date. Depending on your circumstances, the Judge may or may not allow additional continuances.

For Court appointed attorneys the Court Administrator may reset the case up to three times. After 3 setting the Defense Attorney must have the Judge's permission. For retained attorneys the Court Administrator may reset up 4 resets. After the fourth reset the attorney must talk to the Judge to get a reset.
