THE DUTY TO OBTAIN INFORMED CONSENT The duty to obtain a patient's consent for treatment rests on the patient's treating physician (6). Hospitals, nurses, surgical assistants, and referring physicians do not owe this duty to their patients (7).

The following are the required elements for documentation of the informed consent discussion: (1) the nature of the procedure, (2) the risks and benefits and the procedure, (3) reasonable alternatives, (4) risks and benefits of alternatives, and (5) assessment of the patient's understanding of elements 1 through 4.

You will also be asked to sign an informed consent form. This form states that you understand everything about your surgery. You should read through the consent carefully before signing it. Ask your doctor if you have any questions or need more information.

And because physicians are in charge of a patient's care, they're the ones who are ultimately responsible for making sure patients understand the risks, benefits, and alternatives to a given treatment. Someone else can collect the paperwork, but doctors are the only ones who can really ensure informed consent.
