In the ordinary circumstance, a person may reside as an occupant or a roommate in a rental unit with or without the consent of the landlord provided that the tenant also resides in the rental unit. In some cases, a written tenancy agreement may provide who is an occupant of the rental unit.

Names of all tenants. Every adult who lives in the rental unit, including both members of a married or unmarried couple, should be named as tenants and sign the lease or rental agreement. This makes each tenant legally responsible for all terms, including the full amount of the rent and the proper use of the property.

A tenant can make a written request at any time to assign their tenancy to someone else. The request should include the contact details of the person being proposed to take over the tenancy. The landlord must consider all requests on a case-by-case basis and not decline unreasonably.

The reason a manager WANTS both names on the lease is that it makes both people mutually responsible for the rent to be paid. Moving out does not relieve you of this obligation.

Once the landlord's consent has been obtained, the tenant and assignee can enter into a deed of assignment to transfer the lease to the assignee. If the lease is registered at the Land Registry the assignee will then need to register the assignment at the Land Registry.

In some cases, all tenants are named in the agreement. In other cases, only one person is named, however, as a rule, the landlord has the right to know who is living in the unit, and roommates should be listed as tenants or occupants.
