Understanding an Unrecorded Deed An unrecorded deed is a deed for real property that neither the buyer nor the seller has delivered to an appropriate government agency. Unrecorded deeds can present many issues for sellers (or grantors) and buyers (or grantees) such as proof of ownership and tax implications.

A land contract is a written legal contract, or agreement, used to purchase real estate, such as vacant land, a house, an apartment building, a commercial building or other real property.

A land contract is a form of seller financing. The land contract is recorded with the Register of Deeds, giving notice to all of the vendee's interest in the real estate and the vendor's obligation to convey the real estate upon full payment.

Registering a Land ContractA land contract is not legally required to be recorded in Michigan. However, both the buyer and the seller may wish to record the contract to protect their interests in the property.The land contract should be signed in front of a notary public or local judge.

To be enforceable, a purchase contract must set out the essential terms of the agreement; in particular, it must clearly describe the "three Ps" (parties, property and price) and other key terms such as the completion date and the particulars of any vendor financing or leaseback.
