More than 22.1 million people were impacted by the breaches. They now have until Dec. 23 to file a claim for damages. The plaintiffs are part of a class action lawsuit that reached a $63 million settlement earlier this year with OPM and its contractor, now known as Peraton Risk Decision Inc.

The time-limited, policy-limit demand must be accepted within 30 days of the transmission date if by email, certified mail, or fax and within 33 days when transmitted via mail. An unequivocal settlement offer for any claim within the policy's limits, including lien satisfaction where applicable.

What does the Settlement provide? Defendants will pay $63,000,000 into a Settlement Fund, which will be distributed to Class Members who submit Valid Claims. Class Members who submit Valid Claims will receive $700 or the actual amount of the claim?whichever is higher?up to a maximum of $10,000.

On October 14 , 2022, the Court granted Final Approval to the parties' $63,000,000 Settlement. The Final Approval Order is posted on the Documents page of this site. The claim filing deadline was December 23, 2022.

Facebook formally agreed to a $725 million payout on Dec. 23, 2022, and a federal judge issued issued a tentative approval in late March 2023. Final approval of the settlement is expected in September 2023. In the meantime, eligible Facebook users can immediately file claims.

Customers sued Capital One, arguing that the company didn't protect their information. Capital One ended the lawsuit by settling for $190 million in December 2021 (without admitting any wrongdoing). The courts approved the settlement plan on Sept. 13, 2022.
