Limit Number Lease For Free

The Fair Housing Act, enacted by The U.S. Department of Housing and Urban Development (HUD), regulates how many people can live in a rental unit. This law permits two tenants per bedroom ? or four people total ? unless a lower or higher number can be justified.

As expected, the laws concerning occupancy limits for apartments can vary depending on state and city. Fair housing regulations state that two people per bedroom is a reasonable standard that landlords can follow.

The roommate law has several restrictions. New York law does not permit the number of occupants to exceed the number of tenants, and each person residing in the apartment must have a livable area of at least 80 square feet. The square footage count does not include bathrooms, closets or hallways.

The number of bedrooms usually determines the number of people who can live in a house. Some local ordinances base their maximum occupancy limits on the overall square footage of the home, or the square footage per bedroom. Children don't usually factor into this number.

A: New York City's Administrative Code Section 27-2075 governs how many people you can have per square feet in an apartment, but the law allows for a lot of people. Generally, the rule is 80 square feet per person. (Note, an 8x10 room is 80 square feet.)

Except as provided by Subsection (b), the maximum number of adults that a landlord may allow to occupy a dwelling is three times the number of bedrooms in the dwelling.
