Section 32(1) defines the scope of the Charter's application. The text of section 32(1) provides ?a strong message that the Charter ? is essentially an instrument for checking the powers of government over the individual? : McKinney v. University of Guelph, [1990] 3 S.C.R. 229 at 261.

Analysis. Section 33 allows Parliament or the legislature of a province to derogate from certain sections of the Charter, namely section 2 (fundamental freedoms), sections 7 to 14 (legal rights) and section 15 (equality rights).

10. Every person has a right to full and equal recognition and exercise of his human rights and freedoms, without distinction, exclusion or preference based on race, colour, sex, sexual orientation, civil status, religion, political convictions, language, ethnic or national origin or social condition.

Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief and freedom, either alone or in community with others and in public or private, to manifest his religion or belief, in worship, teaching practice and observance.

7. Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in ance with the principles of fundamental justice.

26 The guarantee in this Charter of certain rights and freedoms shall not be construed as denying the existence of any other rights or freedoms that exist in Canada.

This section, often referred to as the ?notwithstanding clause,? allows federal, provincial and territorial parliaments and governments to temporarily override or supersede certain Charter rights.
