Retirement accounts like an IRA, Roth IRA, 401K, 403b, 457 and the like don't belong in your trust. Placing any of these assets in your trust would mean that you're taking them out of your name to retitle them in the name of your trust. The impact this will have on your taxes can be disastrous.

Not all bank accounts are suitable for a Living Trust. If you need regular access to an account, you may want to keep it in your name rather than the name of your Trust. Or, you may have a low-value account that won't benefit from being put in a Trust.

If you want to pass on certain assets before you die, a trust may also help. One of the main reasons people put their house in a trust is because assets in a trust do not go through probate after you die, while everything you bequeath through your will does go through probate.

The beneficiary of the trust cannot establish the trust, nor can he or she contribute their own assets to the trust. Once established, the trust is irrevocable and the assets cannot be withdrawn, except in accordance with the terms of the trust agreement.
