Trust property doesn't belong to the trustee. The property owned by an irrevocable trust isn't legally the property of the beneficiary until it's distributed in ance with the trust agreement. Although the IRS can't seize the property, there might be a way it could file a lien against it.

New York law protects the confidentiality of private trust documents from those who are not beneficiaries but provides that trust beneficiaries have a legal right to obtain a copy of the trust documents.

When a court or the IRS determines the ownership of an asset, the key factor is control. Since the grantor continues to control the assets in a revocable trust, those assets are not protected from creditors and continue to be treated as if the grantor owned them personally.

At death, a copy of the trust generally suffices for all parties in place of the original. Generally a court is not involved in administering a trust. But safeguarding the original copy of your living trust should be the goal. The safest place, though inconvenient, is in a San Diego bank or credit union.

The IRS and Irrevocable Trusts When you put your assets into an irrevocable trust, they no longer belong to you, the taxpayer (this is different from a revocable trust, where they do still belong to you). This means that generally, the IRS cannot touch your assets in an irrevocable trust.

In California, trust beneficiaries are entitled to receive a copy of the trust as long as the trust has become irrevocable (i.e. the trust can no longer be changed.) The same is true for heirs of the settlors (the people who created the trust) who aren't named as beneficiaries.

If a trust is a grantor trust, then the grantor is treated as the owner of the assets, the trust is disregarded as a separate tax entity, and all income is taxed to the grantor.

This rule generally prohibits the IRS from levying any assets that you placed into an irrevocable trust because you have relinquished control of them. It is critical to your financial health that you consider the tax and legal obligations associated with trusts before committing your assets to a trust.

Trusts aren't public record, so they're not usually recorded anywhere. Instead, the trust attorney determines who is entitled to receive a copy of the document, even if state law doesn't require it.

You can get a copy of a trust document by asking the trustee for a copy. If they refuse to provide it, you can compel them to provide a copy through a Surrogate's Court proceeding to compel a copy of the trust. Unlike wills that are admitted to probate, trusts are not part of public records.
