To terminate an active trust, a party with standing must petition the court and provide evidence that persuades a judge to issue an order dissolving the trust or all beneficiaries of the trust must agree to its termination.

The grantor determines what happens to the trust's assets and how they're to be distributed. The trustee carries out these directives. Again, this means you can't just withdraw from a trust fund.

As long as you're mentally competent, you can remove property from your revocable trust at any time. If you're not competent, your successor trustee or power of attorney can do so. It's simply a matter of reversing the process by which you funded the trust with the property in the first place.

Even if there are assets, such as homes, to be sold, the Trust should be wrapped up and distributed within eighteen months. Rarely should a Trust take two years, or more, to make a Trust distribution.

Living trusts are generally revocable by the settlor, which means that they can be changed or revoked by the settlor during their lifetime. Under some circumstances, however, a trust may be revocable even after the settlor has died.
