Lease Expiration or Termination Once the lease expires, you no longer have the right to live in the property unless you get the lease extended or sign a new lease. This is true even if you were to continue paying rent. That said, your landlord doesn't have the right to evict you immediately after your lease expires.

A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out.

The North Carolina Office of Administrative Hearings and the Fair Housing Act prohibit landlords from discriminating against potential tenants because of their race, religion, familial status, sex, gender, etc.

The letter should include: Your name, current address and contact information. Date the lease extension request is submitted. Length of the lease extension, including the proposed end date. Reasons for extension. Date by which you need a decision, usually 10 days to two weeks.

If you do nothing, the lease automatically becomes a month-to-month periodic tenancy (Civil Code Section 1945), but the landlord can potentially terminate upon 30 days' notice (although this termination right of the landlord is limited in some cities ? see below).

A landlord must allow the tenant to renew the lease unless the landlord has good cause for an eviction under the Anti-Eviction Act. (This does not apply to two or three-family owner occupied dwellings, motels, hotels, transients or seasonal tenants).

The notice should have your name, the unit you are occupying and the date in which you will be completely moved out. It should also include a forwarding address to where your security deposit can be mailed. If you have a month-to-month rental agreement, a 30-day notice should be provided to the landlord.
