It is DON policy to adopt digital signatures as the preferred means of conducting business transactions within the DON. This policy does not prohibit physical signatures, but digital signatures enable authentication of electronic documents and assure both the identity of the sender and the integrity of the document.

Guidelines for digital signature requirements are prescribed in DoD Instruction 8520.02. Electronic or digital signatures may be used where an authorized signature is required on a paper document. DoD uses EDA for the centralized repository of all official payment documentation.

The Act makes clear that no person is required to use electronic records, signatures, or contracts. Indeed, E-SIGN requires that a consumer affirmatively consent to the use of electronic notices and records. Prior to consenting, the consumer must receive notice of his or her rights.
