In most cases in Virginia, if your property taxes are delinquent on December 31 following the second anniversary of the due date, the locality can start a foreclosure on your home by filing a lawsuit in court seeking permission to sell the property.

Penalty for late payment (PLP) of real estate taxes is 10% of the amount due and is applied automatically after the due date. Real estate is paid in two installments, so a penalty will be applied for each installment that is late. For Tax Year 2020 ONLY, the Board of Supervisors reduced that rate to 5%.

North Carolina does not sell tax lien certificates. The state sells tax deeds wo you can purchase real estate outright, and you get the property without a mortgage or deed of trust.

Anyone can attend these auctions, though at some venues, you may be required to prove that you have the funds to bid.

The Commonwealth of Virginia does not authorize the transfer of title to real estate upon payment of delinquent taxes (tax lien sales). The City of Chesapeake does conduct judicial sales of property through public auctions for nonpayment of taxes in ance with Code of Virginia Section 58.1-3965 et seq.
