There are generally five types of leases that may form a landlord-tenant relationship: fixed term lease, lease for life, periodic tenancy, tenancy at will, tenancy at sufferance, and perpetual lease.

Fixed term leases do not have a notice period. The tenancy period ends on the date stated in the lease. There is no right or obligation to stay in the rental unit after the fixed term lease ends.

Landlords can use Form P as the residential lease agreement they provide to their tenant to sign. Form P includes all of the conditions that apply in a residential lease agreement, even if another lease or verbal agreement is used.

In order to change a lease, a lessor must first of all give the lessee a written notice3 to inform them of the proposed modifications. This notice must be given within a certain time frame, depending on the type and length of lease. See the table of notice periods below.

Generally, in Quebec, a tenant has the right to maintain occupancy of their rental property. However, a landlord can lawfully evict a tenant if they wish to subdivide, enlarge substantially, or change the use of the property.

Lease Types There are two types of lease in Nova Scotia. The first is a fixed-term lease which begins and ends on the dates specified on the lease. There is no automatic renewal clause on a fixed-term lease. A periodic lease can be week-to-week, month-to-month, or year-to-year.

The current cap of two per cent per year remains in place until December 31, 2023. The rent cap applies to residential tenants who are renewing their lease or those in a fixed-term lease who are signing another fixed-term lease for the same unit.
