Misconception #1: You can sign a power of attorney if you are legally incompetent. Someone cannot appoint a power of attorney (or sign any legal document) if they are incapacitated.Contrary to popular belief, only a mentally competent individual can appoint a POA for themselves.

To revoke a Power of Attorney you must complete and sign a formal document called a 'Deed of Revocation'. You need to advise your Attorneys and complete a Deed of Revocation form. Once you have completed and signed/witnessed the form you then send copies to your Attorneys.

You can revoke your durable power of attorney as long as you are of sound mind and physically able to do so. The sound mind requirement is not difficult to satisfy. If someone challenged the revocation, a court would look only at whether or not you understood the consequences of signing the revocation.

While laws vary between states, a POA can't typically add or remove signers from your bank account unless you include this responsibility in the POA document.If you don't include a clause giving the POA this authority, then financial institutions won't allow your POA to make ownership changes to your accounts.
