A prenuptial agreement is a contract and must be written clearly to be enforced. If the language needs to be clarified or made more specific, the contract needs to be interpreted by a court, and it may not be enforced in the manner one partner wants (or either party intended).

The short answer is that you can protect, or not protect, nearly anything you want. A valid prenup is legally binding, so whatever you and your partner put into it should stand up in court if you eventually divorce (though every case is different).

You don't need to have any assets to enter a prenup and still protect yourself. In fact, many of our customers do not have any assets (and they may only have debt). Why? Because they know that they will one day be making money and accumulating assets, and a prenup can protect future ?stuff? as well!

These types of assets can include savings, stock options, personal property (car, house, jewelry, etc.), and promised holdings (inheritances, retirement, etc.). In addition to financial securities, debts must also be disclosed within premarital assets (even though a debt isn't generally considered an asset).

Premarital assets and debts "Premarital" assets are any assets that you acquired before your marriage to your fiance. This can be any type of property, such as your savings and brokerage accounts, pensions and retirement funds earned up through the date of the wedding, a car, jewelry, a home, or employee stock options.

When it comes to a prenuptial agreement, both fiances must disclose all of their assets and debts. This is done in the form of a ?financial schedule,? which is a snapshot of all of your income, assets, debt, and future inheritance. This disclosure is attached to the end of your agreement.

Assets acquired during the marriage will be divided and fairly distributed between both parties. Premarital assets typically aren't divided since they were acquired before the marriage. Your prenuptial agreement can list separate property to ensure that these assets are fully protected in a divorce.

A prenuptial agreement does not cover the following: Child custody or visitation matters. Child support. Alimony in the event of a divorce. Day-to-day household matters. Anything prohibited by the law.
