Both spouses in marriage are allowed to have Prenuptial Agreements. Once the agreement is done, it becomes binding upon both parties. The violation of an agreement is forbidden in Islam. However, the terms of the agreement should not be against the teachings of Islam.

Marriage is a contract in Islam and is said to take place after there has been a valid offer and acceptance. In a social context it is said to be the setting for the purpose of legalising sexual intercourse and the procreation of children.

It is important to note that the Muslim marriage contract is not only a religious or cultural ceremony, but it also has legal implications. In some Muslim-majority countries, the contract must be registered with the government in order for it to be legally binding.

Spousal abuse or cheating does not void or invalidate a prenuptial or partition agreement unless the agreement specifically states that. Most prenuptial or partition agreements do not mention abuse or cheating.

The prenuptial agreement must be generally fair to both parties and not be unreasonable or oppressive; in the law, this is referred to as 'unconscionable. ' What qualifies as unreasonable or unconscionable varies by case, but the prenup can be overturned if the judge decides the agreement is too one-sided to be fair.

If you don't sign a prenup, state laws will govern property division, spousal support, and finances during divorce, potentially putting certain assets at risk. The agreement is found to be extremely one-sided. Prenups are not enforceable if they are found to be unconscionable or in extreme favor of one spouse over the other. For example, an agreement that forced one spouse to take all of the marital debt while the other takes no debt may be considered unconscionable.
