Before a promissory note can be canceled, the lender must agree to the terms of canceling it. A well-drafted and detailed promissory note can help the parties involved avoid future disputes, misunderstandings, and confusion. Since promissory notes are legally binding documents, taking the matter to court is your best chance at getting the borrowed money back if all effort fails. However, this is the point where you should stop and think about your goals and whether gaining the money-back balances out the time and cost it will take.

A promissory note may include a default on secured debt as part of the agreement. This means that if the borrower fails to pay under the agreed-upon terms of the promissory note, then the lender can take the secured debt as a form of payment.
