The drawback, quite simply, is that quitclaim deeds offer the grantee/recipient no protection or guarantees whatsoever about the property or their ownership of it. Maybe the grantor did not own the property at all, or maybe they only had partial ownership.

If you draw up a valid quit claim deed and record it, you cannot "reverse" the transfer of property interest unless you prove to a court that it resulted from fraud or other illegal influence.

The biggest risk to using a quitclaim deed is that there are no guarantees of actual ownership, so you might not actually have a legal right to own the property. In a worst-case scenario, a grantor could transfer the property title to you and lie about being the true owner.

Once a quit claim deed has been completed and filed with the County Clerk's Office, the title will officially pass from the grantor to the grantee. The only way to reverse a quit claim deed is to go to court and prove that the grantor was forced to sign the document under duress.

"Quitclaim deeds," "quit claim deeds" and "quick claim deeds" are the same thing. Their proper name is "quitclaim deed," but the confusion about the name is understandable, since, in essence, a person using a quitclaim deed is "quitting his claim" on a property very quickly!

Once the transfer is complete, there is no way to nullify or undo a quitclaim deed unless both parties consent to the arrangement. If the original grantor does agree to take back the property, you must draft and file a new quitclaim deed to void the original.

If the judge decides undue influence was used to get another person to sign the quit claims deed, odds are the form will be revoked. If the judge decides no undue influence or other fraudulent attempts were made to get the other person to sign, the quit claim will remain on file as it currently stands.
