Quitclaim Deed Insert Checkmark For Free

A quitclaim deed is a deed by which a grantor transfers only the interest the grantor has at the time the conveyance is executed. The grantor is not promising anything other than that they are giving up their own rights, if any. There are no implied warranties in connection with a quitclaim deed.

No guarantees to the new owner: Unlike a warranty deed, a quitclaim deed does not guarantee that a property is free from title defects such as tax liens or title claims from third parties. For this reason, it is a poor legal instrument to use when selling a piece of property for cash considerations.

Signing Requirements: § 442.130 ? The grantor's signature must be notarized, while witnesses are not obligatory for a quitclaim deed. Another authorized officer can also acknowledge the grantor's signature. Recording Requirements: § 442.400 ? A quitclaim deed should be recorded with the County Recorder of Deeds.

Recording (V.A.M.S. 442.400) ? Must be filed at the County Recorder of Deeds. Signing (V.A.M.S. 442.130) ? All quit claim deeds are to be signed with the Grantor(s) in the presence of a Notary Public.

Once a quitclaim deed has been signed, delivered, and recorded with the appropriate county recorder's office, it typically cannot be reversed or ?undone? by the grantor (the person who transferred their property interest).

Due to this, quitclaim deeds typically are not used in situations where the property involved has an outstanding mortgage. After all, it would be difficult for many grantors to pay off a mortgage without proceeds from the sale of the property.

Based on that interpretation, it shouldn't ruin your credit if you signed over the condo with a quitclaim deed. Most sellers who do this sort of financing don't report to the credit bureaus unless they do a lot of buying and selling of properties to people who can't qualify for mortgages on their own.

If the judge decides undue influence was used to get another person to sign the quit claims deed, odds are the form will be revoked. If the judge decides no undue influence or other fraudulent attempts were made to get the other person to sign, the quit claim will remain on file as it currently stands.

When you sign a deed transferring your interest in real property, you cannot reverse it simply because you regret your decision. Assuming you are on congenial terms with the person who was the grantee of your deed, he can sign a similar deed transferring the property interest back to you.
