A record or signature can't be denied legal effect or enforceability simply because it's in electronic form. A contract can't be denied legal effect or enforceability simply because an electronic record was used in its formation. The legal requirement that a deed must be signed 'in the presence of a witness' requires the physical presence of that witness.
