As the Trustor of a trust, once your trust has become irrevocable, you cannot transfer assets into and out of your trust as you wish. Instead, you will need the permission of each of the beneficiaries in the trust to transfer an asset out of the trust.

Revocable trusts let the living grantor change instructions, remove assets, or terminate the trust. Irrevocable trusts cannot be changed; assets placed inside them cannot be removed by anyone for any reason. Revocable trusts allow beneficiaries to avoid probate court and guardianship or conservatorship proceedings.

Because of this, irrevocable trusts can also be used to reduce estate taxes. Grantors can add additional money to the trust each year, up to the gift-tax exclusion amount, to pass money to heirs without paying estate tax.

Frankly, just about any asset can be transferred to an irrevocable trust, assuming the grantor is willing to give it away. This includes cash, stock portfolios, real estate, life insurance policies, and business interests.

A grantor of an irrevocable trust creates the trust and contributes funds or property to the trust. However, the grantor cannot amend or revoke the trust agreement.

Don't transfer IRA's or 401(k)'s to the trust. Don't allow beneficiaries to return to the trust or the Grantor any gifts made from trust assets. Don't make additional transfers to the trust in the future without advising the elder law estate planning firm.

It's generally in your best interest to go with a shorter name for your trust since the longer a name the higher the chance of misspellings or issues with abbreviations due to a lack of space on forms. In other words, ?Doe Family Trust dated 10/11/12? is preferable to ?John R. Doe and Jane U.

This should include the titles and deeds to real property, bank account information, investment accounts, stock certificates, life insurance policies, and other assets you will be using to fund the trust.

Generally, you should title all of your currently owned and newly acquired assets in the name of your trust. We prefer the following format for titling assets in the name of your trust: NAME OF TRUSTEE, Trustee of the NAME OF TRUSTEE Living Trust dated DATE TRUST WAS SIGNED and any amendments thereto.
