Cardholders have the right to dispute a credit or debit card transaction if it was unauthorized or illegitimate. If a transaction is disputed, the cardholder is no longer required to make payment. Rather, the merchant sacrifices revenue ? funds are removed from the merchant's account and returned to the cardholder.

Your card issuer reviews the dispute and will decide if it's valid or if you have to pay. If your issuer accepts the dispute, they'll pass it on to the card network, such as Visa, Mastercard, American Express or Discover, and you may receive a temporary account credit.

Who pays when you dispute a charge? Your issuing bank will cover the cost initially by providing you with a provisional credit for the original transaction amount. After filing the dispute, though, they will immediately recover those funds (plus fees) from the merchant's account.

The merchant is simultaneously notified that they've received a dispute from the cardholders, and that the acquiring bank has debited funds from the merchant account to reimburse the cardholder for the transaction and to cover the fees for investigating the chargeback.

Generally, the bank must mail or deliver written acknowledgement to you within 30 days of receiving your written billing error notice. If the bank determines that a billing error has occurred, it shall resolve it within two complete billing cycles?but no later than 90 days after receiving a billing error notice.

If the merchant doesn't respond, the chargeback is typically granted and the merchant assumes the monetary loss. If the merchant does provide a response and has compelling evidence showing that the charge is valid, then the claim is back in the hands of the consumer's credit card issuer or bank.

The cardholder may not recognize the charge and therefore beleive it to be fraudulent, or may have had an issue with their purchase that they were unable to resolve with the merchant.
