Most California workers must receive the following breaks: An uninterrupted 30-minute unpaid meal break when working more than five hours in a day. An additional 30-minute unpaid meal break when working more than 12 hours in a day. A paid 10-minute rest period for every four hours worked.

California Rest Breaks The amount of rest time the employee receives corresponds to the length of their shift. Employees must get 10 consecutive minutes for a break every 4 hours. If the employee works a fraction of their work that is 2 hours or more, then they must receive a break.

While Kentucky law does define what constitutes ?reasonable,? it is commonly accepted to be an unpaid period of 30 minutes or more. Rest breaks are governed by KRS 337.365, under which an employer must provide employees with a paid 10-minute break every four hours of employment.

Meal Break Obligations In California. You cannot employ someone for a work period of more than five hours without providing an unpaid, off-duty meal period of at least 30 minutes. The first meal period must be provided no later than the end of the employee's fifth hour of work.

In Texas, there are no labor laws in breaks, so employees do not have a right to breaks and employers are not required to provide a certain number of breaks even during a 12-hour shift. However, it is common for workplaces to provide one meal break (30 mins.) and two rest breaks (15 mins. each) during a shift.

The Occupational Safety and Health Administration (OSHA) says that a normal work shift is no more than 8 consecutive hours in a day, with each shift split by at least 8 hours of rest. A normal workweek is 5 such work days.

If an employee works 8 or more consecutive hours, the employer must provide a 30-minute break and an additional 15 minute break for every additional 4 consecutive hours worked.
