Quitclaim deeds lack certain protections and promises found in other types of deed to real property. Because of this, they should only be used under certain circumstances. These include transferring real estate between close family members, for instance, from a parent to a child.

A deed must meet the following requirements to be valid: (1) be in writing; (2) name the parties; (3) give the legal description of the property; (4) specify the legal rights being conveyed; (5) include a consideration; and (6) be signed by a competent grantor and witnessed by two persons.

The deed or assignment of lease must be signed (in black ink) by the current owner and the new owner before a notary public. The deed or assignment of lease must be recorded in the State of Hawaii Bureau of Conveyances or Land Court. A Conveyance Tax Certificate must be filed and any tax due must be paid.

A Maryland deed is used to transfer ownership in real estate from one person (usually called the grantor, or seller) to another (usually called the grantee, or buyer). In Maryland a deed must include the name of the grantor and the grantee, the consideration paid for the property.

You may prepare a deed on your own; however it is a good idea to have someone with a certain expertise in the field such as a real estate agent, attorney, or title company prepare it for you. A deed is binding even if it is not recorded, but because of numerous reasons it is in your best interests to record it.

Notarization. A Pennsylvania deed cannot be recorded unless the transferring owner acknowledges the deed before a notary or other officer with authority to take acknowledgments. Pennsylvania's real estate laws include a model notary certificate for deeds.

Pennsylvania's law falls under what scholars call a ?race jurisdiction.? This means that deeds that are recorded first in time are presumptively valid. In other words, unlike in Monopoly, it doesn't help to simply have a physical deed; you have to actually record your deed at the Courthouse.
