What is a 'strike out'? If a case is 'struck out' it means the Court has dismissed it without a full hearing of all of the evidence. There are particular rules governing how a civil case may proceed; these are Civil Procedure Rules.

Verb. be unsuccessful in an endeavor. ?The candidate struck out with his health care plan? type of: fail, go wrong, miscarry.

If the court determines that the claimant or defendant have no 'reasonable' grounds for bringing the case or defending it, or there has been an abuse of process or the Civil Procedure Rules have not been complied with, the court will grant the strike out application.

Before the creditor starts court action by sending you a claim form they should send you a letter of claim. The pre-action protocol sets out what the letter of claim should include. The letter should tell you the amount of the debt and whether interest is being added.

An application must be made within 14 days after the judgment was served. Failing that an application must be made for relief from sanctions. where there was no entitlement to a strikeout in the first place. Entire proceedings can be struck out if one or both parties do not attend the trial under CPR 39.3.

Judges may grant partial summary judgment. For example, a judge might rule on some factual issues, but leave others for trial. Alternately, a judge might grant summary judgment regarding liability, but still hold a trial to determine damages.
