Section 1262 of the 'Consolidated Appropriations Act of 2023' removes the federal requirement for practitioners to apply for a special waiver prior to prescribing buprenorphine for the treatment of opioid use disorder.

Under the DATA 2000 requirements, physicians must complete an eight-hour training to qualify for a waiver to prescribe and dispense buprenorphine.

The U.S. Food and Drug Administration (FDA) determined that the drug was not taken off the market because of concerns about safety or effectiveness. Subutex is still available in other parts of the world, and generic forms of sublingual buprenorphine are available in the United States.

Individuals with opioid use disorder (OUD) often struggle to find physicians that prescribe buprenorphine. Many physicians do not have the waiver to prescribe buprenorphine, and a large proportion of physicians that are waivered do not prescribe to capacity.

The DATA-Waiver (also known as the X-waiver) was created under the Drug Addiction Treatment Act of 2000 (DATA 2000), to allow certain qualified practitioners to treat patients with buprenorphine outside of an opioid treatment program (OTP), often referred to as a ?methadone clinic?.

Waiver registration is no longer required to treat patients with buprenorphine for opioid use disorder. Going forward, all prescriptions for buprenorphine only require a standard DEA registration number. The previously used DA TAWaiver registration numbers are no longer needed for any prescription.

Under the Drug Addiction Treatment Act of 2000 (DATA 2000), physicians who have completed the mandatory eight-hour training course are now eligible to obtain a DEA-X waiver to administer and/or prescribe buprenorphine medication-assisted therapy to treat opioid use disorder.

The new rule means nearly all doctors can prescribe buprenorphine, also called by brand name Suboxone. Previously, most doctors had to seek a special waiver and have an eight hour training to be approved to do so and now physicians can prescribe regardless of if they get that training.

A 30-level waiver allows providers who wish to treat up to 30 patients to prescribe Buprenorphine. For this level waiver, physicians need 8 hours of training and APRNs or PAs need 24 hours of training.
