The purpose of the suit was to prove that there was no record of any prior suit between these companies when it was a private mining firm. This suit was appealed on the grounds that Southwestern had never been a private corporation and that there had been no agreement whereby an individual would be bound to keep private communications between the mining operations. The appeals court upheld the ruling that there had been no pre-existing agreement between the parties, because prior to Southwestern being incorporated there had been no agreement whereby an individual would have been bound to keep such communications a secret. The decision stated that the mining companies were not the subjects of the suit. The agreement with the Southwestern Research Center does not apply to the other corporations, because, it states that the Southwestern Research Center does not control the mining companies.
