These rest breaks must be counted as time worked and must be paid time.

California Rest Breaks California requires employers to provide employees ten-minute rest breaks for every four hours (or major fraction) worked. Anything over two hours is a ?major fraction? of a four-hour period.

?According to the California Wage Orders, it is not permissible for an employer and an employee to enter an agreement which violates this requirement, nor is it permissible to 'tack on' rest periods to meal periods in an effort to circumvent rest period requirements.
