FAQ

The Tenant Protection Act of 2019 (AB 1482) restricts rent increases in any 12-month period to no more than 5% plus the percentage change in the cost of living (CPI), or 10%, whichever is lower. For increases that take effect on or after Aug. 1, 2022, due to inflation, all the applicable CPIs are 5% or greater.

With extensions on the COVID-19 Tenant Relief Act, tenants who amassed rent debt between March 2020 and the end of September 2021 can't be evicted due to that debt as long as they submitted a pandemic-related hardship declaration and, in some cases, paid 25% of the rent.

Tenants cannot be evicted unlawfully in the state of California. However, a landlord has the right to evict a tenant after failing to pay rent on time. In California's housing law, the rent is considered late the day after its due date.

According to AB 1482, rent increases are capped at 10% even if the CPI is greater; therefore, the max allowable rent increase is 10% annually, effective July 1, 2022.

Additionally, on March 23rd the Mayor issued a temporary moratorium on evictions for non-payment of rent for tenants who are unable to pay rent due to circumstances related to the COVID-19 pandemic. Ordinance No. 186585 effective March 31, 2020, provided additional protections and effective , Ordinance No.

It is important to note that the City of Long Beach is subject to the Los Angeles County's Eviction Moratorium which prohibits no-fault evictions based on substantial remodel through the end of 2022.

The CA COVID-19 Rent Relief program will continue to help eligible Californians at risk of eviction to apply to receive money for rent and utilities through March 31, 2022. Eviction protections are also through March 31, unless your local city or county has extended protections.

If your tenant won't fix the problem or move out, you'll have to go through the court to get an order for them to move out. The eviction process can take 30 - 45 days, or longer. The time starts from when you have eviction court forms delivered to your tenant to the time they must move out.

After more than two years and multiple extensions, most remaining elements of California's COVID-19 eviction moratorium have come to an end. June 30 was the last day for both the COVID-19 Tenant Relief Act (CTRA) and the COVID-19 Rental Housing Recovery Act.

For example, if you live in Long Beach, which is Los Angeles County, you may have a number of 12.9%. However, that is not the maximum a landlord can raise the rent in Long Beach. That's because California's AB-1482 rent control law caps the maximum allowable annual rent increase to only 10%.
