This Option to Purchase Addendum to Residential and Lease Agreement is entered into by and between the lessor and the lessee. The lessor agrees not to offer the residence for sale to anyone during the term of the lease, and to give the lessee (tenant) the option to purchase the residence at any time prior to the expiration of the lease, provided the lessee gives notice of intent to purchase in accordance with the provisions of the Addendum. At that point, a separate contract of sale will be executed and the sale will proceed as any sale would.
Please note: This Addendum form is NOT a lease agreement. You will need a separate Residential Lease Agreement. The Addendum would be attached to that Agreement
The Nampa Idaho Option to Purchase Addendum to Residential Lease is a legal document that provides tenants with an opportunity to potentially purchase the property they are leasing in the future. This addendum, also known as a Lease or Rent to Own agreement, offers tenants the option to buy the property after a specific period of time, usually ranging from one to three years. By entering into this agreement, tenants have the flexibility to rent and live in the property while having the potential to become homeowners. There are different types of Nampa Idaho Option to Purchase Addendum to Residential Lease — Lease or Rent to Own agreements that can be tailored to meet the specific needs of the landlord and tenant. Some of these variations include: 1. Fixed Purchase Price Addendum: This type of addendum specifies a predetermined purchase price that will remain unchanged throughout the lease term. This allows tenants to know the exact amount they would need to pay if they choose to exercise their option to purchase. 2. Escalating Purchase Price Addendum: In contrast to the fixed purchase price addendum, an escalating purchase price addendum determines that the purchase price increases by a certain percentage or amount after each year of the lease term. This option gives tenants time to save, as well as provides an incentive for them to make the decision to buy sooner rather than later. 3. Rent Credit Addendum: This type of addendum offers tenants the benefit of accumulating a portion of their monthly rent payments as a credit towards the purchase price. For example, if the rent is $1,500 per month and the rent credit is set at 20%, $300 of each month's rent payment would be reserved as a credit toward the future purchase of the property. 4. Lease Term Addendum: With this addendum, tenants can modify the length of the lease term, providing more time for them to decide if they wish to exercise the option to purchase. This flexibility can be particularly useful for tenants who want to thoroughly assess the property and evaluate their financial situation before committing to becoming homeowners. 5. Maintenance Responsibility Addendum: This addendum clearly outlines the responsibilities of both the landlord and the tenant regarding property maintenance and repairs during the lease term. It may specify which party is responsible for major repairs and improvements, ensuring that both parties have a clear understanding of their obligations. The Nampa Idaho Option to Purchase Addendum to Residential Lease — Lease or Rent to Own offers several benefits for both tenants and landlords. Tenants have the opportunity to evaluate the property before making a long-term commitment to purchase, while also allowing them to build credit and save for the down payment.
