This form is for use by a Landlord to terminate a month-to-month residential lease. "Residential" includes a house, apartment, or condo. Unless a written agreement provides otherwise, the Landlord does not have to have a reason for terminating the Lease in this manner, other than a desire to end the lease. A month-to-month lease is one which continues from month-to-month unless either party chooses to terminate. Unless a written agreement provides for a longer notice, 7 days notice is required prior to termination in this state. The notice must be given to the Tenant within at least 7 days prior to the termination date. The form indicates that the Landlord has chosen to terminate the lease, and states the deadline date by which the Tenant must vacate the premises.

Tenants can use the North Carolina Tenant Notice to Vacate Form to inform landlords and property managers of their intention to vacate the rental property at least 30 days before they intend to move out, or longer if required by the terms of their North Carolina Lease Agreement.

A North Carolina month-to-month rental agreement is a rental contract with no end date between the landlord and a tenant. The end date is determined by either the landlord or tenant by providing notice to terminate.

In most states, landlords must provide 30 days' notice to end a month-to-month tenancy. (There are a few exceptions, such as North Carolina, which requires only seven days' notice, and Delaware, which requires 60 days' notice.)

For month-to-month leases, there must be seven days of notice. For year-to-year leases or those with other definite terms, landlords must notify the tenant, or vice versa, within a month of the end of the lease. On leases lasting between one week and one month, notice must be given at least two days in advance.

Landlords cannot force tenants out of their homes without going to court, for instance, by changing the locks, turning off utilities or removing the doors. Landlords may send tenants ?eviction notices? warning tenants that they plan to file for eviction unless the tenant moves out first.

A tenancy from year to year may be terminated by a notice to quit given one month or more before the end of the current year of the tenancy; a tenancy from month to month by a like notice of seven days; a tenancy from week to week, of two days.
