A restraining order allows individuals to obtain protection from alleged domestic violence without immediately having to file for legal separation or divorce. In Oregon, these orders are provided for in the Family Abuse Protection Act (FAPA) and are commonly referred to as FAPA restraining orders.

A restraining order will remain in place for exactly one year from the date it is signed by a judge, unless sooner dismissed by the petitioner or by the court after a hearing.

Violating a restraining order isn't a crime in Oregon, but you may be held in contempt, which does have penalties. Contempt can result in fines up to $500 or six months in jail.

If you want to drop your restraining order, you need to go back to the court that issued your order and fill out a request (motion) to dismiss the order. You may have to talk to the judge and tell him/her why you want to drop the restraining order.

Contesting (Objecting To) the Restraining Order To ask for a hearing, you must fill out the form called ?Request for Hearing? and mail or deliver it to the court before the end of 30 days from the date you were served with the Restraining Order. The court's address should be on the form.

The victim must file a Petition to Waive the No-Contact Order with the court that has jurisdiction over the case; and. The court must find, after a hearing on the Petition, that waiving the no-contact order is in the best interest of the parties AND the community.

You have 30 days from when you were served with the order to file an objection. Fill out the form called ?Request for Hearing.? You should have received a copy of this form when you were served with the Restraining Order.

Restraining orders last for one year from the day of the judge's signature. To renew the current order, your papers must be filed before the end of that year. You may lose your chance to renew if you do not file before the date the current order ends.
