Any employee working in New York shall accrue sick leave at a rate of not less than one hour per every thirty hours worked, beginning at the commencement of employment or September 30, 2020, whichever is later, subject to the use and accrual limitations of the law.

By law, employers must pay Statutory Sick Pay (SSP) to employees and workers when they meet eligibility conditions, including when: they've been off sick for at least 4 days in a row, including non-working days.

Effective January 1, 2021, the NYC Safe and Sick Leave law requires employers with 100 or more employees to provide up to 56 hours of paid Safe and Sick Leave, and employers with four or fewer employees and a net income of $1 million or more to provide up to 40 hours of paid Safe and Sick Leave.

Part-time workers should be treated the same as full-timers for all your other perks, things like: sick pay, maternity leave, paternity leave, adoption leave, and the pay for that leave.

Federal, state, and local government employees are NOT covered, but employees of charter schools, private schools, and not-for- profit corporations are covered. The law requires employers with five or more employees to provide their employees with paid sick and safe leave.

Employees must earn, or accrue, at least one hour of sick leave for every 30 hours worked, up to 40 hours of sick leave per year. The rate of accrual and the amount of sick leave are the same for all employees, including full-time and part-time employees.

Domestic worker who has worked for you for more than one year, you must provide paid sick leave. Domestic workers get up to two days of paid sick leave every year. This is in addition to the up to three days of paid rest to which they are entitled under New York State Labor Law.

Contrary to popular belief, the usual vacation leaves and sick leaves customarily given to employees are NOT in fact mandatory.
