The request for contractor references must be given to the Department within five working days after the date the final order has been received and the order cannot be delayed. If the contract cannot be awarded without the contractor's reference, the contractor must be given the opportunity to furnish the Department copies of any information, documents or information pertinent to the subject of the contract. The final order must be sent to the final bidder no later through Pending receipt of a timely response to the bidder, an adequate and pertinent response, or a waiver of non-performance without refund. Notice of a waiver of non-performance may be obtained by submitting to the Department an incomplete Form NOC and a copy of the contract or subcontract.
