An employer of ten or more employees must pay to an employee serving on jury duty the first $40.00 of that employee's daily wage for the first three days of jury service. However, the State will pay a jury fee of $40/day for a juror's service for any days that the employer does not pay it.

Members of staff who are called for Jury Service for up to four weeks will be entitled to paid leave to attend court. As they will be paid their full salary there will be no requirement for members of staff to claim loss of earnings from the Court.

New York has a list of specific excuses that can be used to be exempt from reporting for jury duty, including excuses for military, elected official, student, breastfeeding, age, police, medical worker, firefighter and disability.

If an employee attends jury service, the employer may choose: to pay the employee in full during the absence on jury service; to pay the employee to a limited extent, for example full pay for a certain number of days' jury service; to pay the difference between the court allowance and the employee's normal wages; or.

Pursuant to law, the state will pay jurors a fee of $40 for each day of physical attendance with the following exceptions: Exception #1: Jurors who are employed CANNOT be paid a jury fee for any day(s) on which they will receive regular wages unless their regular wage is less than $40.

While jury duty pay in New York won't add up to much, the IRS considers it to be taxable income. Sometimes the court will send you a 1099-G or 1099-MISC form with your jury duty payment, other times you won't receive a 1099.

Federal jurors are paid $50 a day. While the majority of jury trials last less than a week, jurors can receive up to $60 a day after serving 10 days on a trial. (Employees of the federal government are paid their regular salary in lieu of this fee.)

If you do not answer the questionnaire correctly or do not provide proof that you are a non-citizen, you will receive a summons ordering you to appear at court.

The jury fee is $40 per day for all New York State Courts and for Town and Village courts. Every person who serves as a juror in the New York State Courts or the Town and Village courts is entitled to be paid at least the $40 fee for each day that they report in person for jury service.
