(5) The term “Write for Hire” or the “write-for-hire clause” as used herein shall mean and refer to the provisions of this Section 2 that provide an author with the option to write or to be written for hire by, an entity with which the author is not otherwise acquainted or which is not controlled. The term shall not include any provision prohibiting an author from taking or withdrawing a written assignment that is in the author's control. (6) The term “Writing for Hire” as used herein shall include, but not be limited to, offering, directing or directing others to offer, direct or direct others to do an act designed to benefit a third party in exchange for an agreed remuneration, whether remuneration is fixed and determined, in consideration of services rendered by the author.
