In technology licensing, the licensor (firm selling the technology) agrees to unilaterally transfer know-how and intellectual property (IP) related to a technology to the licensee (firm buying the technology).

Technology licenses are agreements in which the owner of technological IP lets another party use, change, or even resell the property in exchange for compensation. The compensation can be either a lump sum royalty, royalties based on the value of production, or the right to use the licensee's technology.

A licensing agreement allows owners of intellectual property to authorize third parties to use, alter, or resell the property for a mutually agreed-upon price, without transferring ownership to the third party.

Licensing a patent simply means that the patent owner grants permission to another individual/organization to make, use, sell etc. his/her patented invention.

Licensing agreements generate revenues, called royalties, earned by a company for allowing its copyrighted or patented material to be used by another company. Some examples of things that may be licensed include songs, sports team logos, intellectual property, software, and technology.

Generally, there are three types of licensing agreements: exclusive, sole, or non-exclusive. In an exclusive license, the licensee is only the party that can use the licensed intellectual property.

A master license is an agreement between a music user and the owner of a copyrighted sound recording, that grants permission to use the recording. This permission is also called a master lease or master rights.

A patent license agreement is a contract between a patent owner (licensor) and a licensee that defines the terms under which the licensee may make, sell, and use a patented invention. The agreement also provides how royalties will be paid to the patent owner.

Section 3.3, Florida's “Moral Rights” statute, provides that persons who acquire rights from another person “under the law of this state” may acquire them on terms that are “equivalent, satisfactory, or reasonable to those they would receive under the law of any other state where[the other person] is authorized to practice law”. This provision provides for the acquisition, via one state's patent or patent application law, of a license to practice a license-granting body's patent or patent application law. It states explicitly that “the license to practice [under this statute] that the person acquiring the rights would receive under the law (as in effect upon the date of [the license granted in] the other states) shall be valid in those other states where the person acquires the rights and be deemed adequate to enable him to practice in those states”. The statute reads as follows: 4.2.1.
