Instead of filing a full Business Income & Receipts Tax return, many small- and medium-sized businesses in Philly can now submit an annual No Tax Liability (NTL) form. Businesses that have $100,000 or less in Philadelphia taxable gross receipts, don't owe the Business Income & Receipts Tax (BIRT).

Business Income and Receipts Tax (BIRT) and Net Profits Tax (NPT) The BIRT is a net income and gross receipts tax imposed on individuals, partnerships, limited liability companies, and corporations engaged in business within the City of Philadelphia.

Philadelphia's BIRT is imposed annually upon every person engaging in any business in the city; it is a privilege tax, taxing for the privilege of doing business in Philadelphia, see Phila. Code Section 19-2603. The BIRT has two components: a net income component and a gross receipts component.

The reduced income-based rate for residents and non-residents is 1.5%. You must attach a completed Pennsylvania Schedule SP for the relevant tax year to your Net Profits Tax return to be eligible to receive the income-based rates.

Who pays the tax. The Net Profits Tax (NPT) is imposed on the net profits from the operation of a trade, business, profession, enterprise, or other activity by: Philadelphia residents, even if their business is conducted outside of Philadelphia. Non-residents who conduct business in Philadelphia.

BIRT Method II taxpayers are required to add back to federal taxable income any 100% bonus depreciation taken on their federal return. Philadelphia permits taxpayers to take normal depreciation deductions on such property IRC 167 and IRC 168, except 168(k).

The current rates for the Business Income & Receipts Tax (BIRT) are 1.415 mills ($1.415 per $1,000) on gross receipts, and 6.20% on taxable net income. In 2019 the rate was 6.25% on taxable net income. The BIRT is based on both gross receipts and net income. Both parts must be fb01led.

The City Wage Tax is a tax on salaries, wages, commissions, and other compensation. The tax applies to payments that a person receives from an employer in return for work or services. All Philadelphia residents owe the City Wage Tax, regardless of where they work.

Non-resident employees who work for Philadelphia-based employers are not subject to Philadelphia Wage Tax during the time they are required to work outside of Philadelphia. The Philadelphia Department of Revenue has not changed its Wage Tax policy during the COVID-19 pandemic.
