[Your Name] [Your Address] [City, State, Zip Code] [Date] [Debt Collection Agency Name] [Address] [City, State, Zip Code] Subject: False or Misleading Misrepresentations in Collection Activities — Falsely Representing that Debtor has or is Committing Criminal Fraud by Nonpayment of a Debt Dear [Debt Collection Agency Name], I am writing to bring to your attention the false or misleading misrepresentations made by your agency in its collection activities regarding a debt supposedly owed by me. I believe it is necessary to address these inaccuracies promptly and rectify the situation. Firstly, let me clarify that I dispute the validity of the debt you are attempting to collect. I have requested validation of this debt in accordance with the Fair Debt Collection Practices Act (FD CPA), and to date, I have not received any documentation proving the legitimacy of this debt. Moreover, I strongly object to the false representation that my nonpayment of this debt constitutes criminal fraud. This intentionally misleading statement is a violation of both federal and state laws governing debt collection. The North Carolina General Statutes prohibits debt collectors from engaging in deceptive or unfair practices, including falsely representing the legal status of a debt. As a resident of Mecklenburg County, North Carolina, I am well aware of my rights under both federal and state laws. In my research, I have discovered that Mecklenburg County specifically has statutes in place to protect consumers like myself from misleading and abusive debt collection practices. Such practices are not only unethical but also illegal. I demand an immediate cessation of all collection activities until you can provide valid and verified documentation supporting the existence and legitimacy of this debt. Additionally, I request that you cease and desist from falsely representing or implying that I have committed any form of criminal fraud by not paying this alleged debt. Please be advised that any further attempts at collection that violate the FD CPA or other applicable laws will be reported to the appropriate regulatory authorities and may result in legal action. I expect a prompt and thorough investigation into this matter and a response within [30 days] from the date of this letter. If you fail to comply with this request, I will have no choice but to seek legal counsel and pursue legal remedies available to me under federal and state laws, including the possibility of filing a complaint with the Consumer Financial Protection Bureau. It is my sincere hope that we can resolve this matter amicably and without further escalation. I urge you to rectify these misleading misrepresentations promptly and demonstrate your commitment to fair and ethical practices in debt collection. Thank you for your attention to this matter. Sincerely, [Your Name] [Your Phone Number] [Your Email Address]
