"(5) Causing charges to be made to any person for communications by concealment of the true propose of the communication. Such charges include, but are not limited to, collect telephone calls and telegram fees." Phoenix Arizona Letter Informing Debt Collector of Unfair Practices in Collection Activities — Causing a Person to Incur Charges for Communications by Concealing the True Purpose of the Communication: Dear [Debt Collector's Name], I am writing to inform you about my concerns regarding the unfair practices I have experienced during the debt collection process. In particular, I believe that your communication tactics have intentionally and deceptively concealed the true purpose of your communications with me, ultimately causing me to incur unnecessary charges for these communications. Firstly, I would like to address the issue of concealing the true purpose of communication. It has come to my attention that your debt collection agency has been engaging in practices that could be considered deceptive under the Fair Debt Collection Practices Act (FD CPA). Specifically, I have received numerous phone calls and written correspondence under the false pretense of being a regular business communication, which later turned out to be attempts to collect a debt. This deception has caused confusion and unnecessary expenses on my part, as I have incurred charges for these communications without prior knowledge of their true purpose. Furthermore, according to the FD CPA, debt collectors are prohibited from engaging in any deceptive practices, including the use of false or misleading representations in connection with the collection of debts. By concealing the true purpose of the communications, I believe your agency's actions have violated this consumer protection law. I kindly request that you cease this unfair practice immediately. I expect future communications from your agency to clearly state their true purpose, specifically indicating that they are related to debt collection. Failure to comply with this request may result in further legal action being taken against your agency. Additionally, I would appreciate a written confirmation within [number of days] that you have taken the necessary steps to rectify this matter and have implemented procedures to ensure that no further deceptive communications occur in the future. If you fail to respond to this letter or continue engaging in these unfair collection practices, I will have no choice but to pursue legal remedies available to me under the FD CPA. Please consider this letter as a formal complaint and a demand for immediate action to rectify the unfair practices conducted by your debt collection agency. I trust that you will take this matter seriously and ensure that similar deceptive tactics are not employed with other individuals. I expect your prompt response and cooperation in resolving this matter to avoid any further escalation. Thank you for your attention to this serious matter.
