See page 9. In the natural gas storage field, the landowner shall provide a means for gas to be stored during the storage period. In other words, the owner shall not be allowed to exclude other natural gas companies from the property because this is a natural gas storage field. This means the natural gas companies must have a right to access the property under certain circumstances. When the owner of a natural gas storage facility permits, leases, or otherwise has a legally established right to exclude others from the facility, this may be a “non-public use” subject to the public nuisance provisions of the California Environmental Quality Act. These non-public use provisions are in Chapter 4 of the Resource Conservation and Recovery Act; in Section 2700 of the Environment Code; and in Regulation 20-1-0105, Subpart F, California Code of Regulations. The facility shall have as its basic service a low-pressure gas compressor.
